TERMS AND CONDITIONS

The following terms and conditions apply to all purchases by the user (defined as “you/your/yours”) from Fandom Cross Stitchery (defined as “we/us/our”). The “site/website” is defined as fandomcrossstitchery.com and covers all information provided on the site including, but not limited to, written text, videos, photographs and other images. ‘Receipt’ is defined as the date the order was signed for with the courier service. As a user of the site, you are deemed to have read, acknowledged and accepted these terms and conditions, which are subject to change without notice at our discretion. If you do not accept these terms and conditions, you should not use the website or place an order.

1. ORDERING

When you place an order with us, you are deemed to have read and accepted these terms and conditions.  We are under no obligation to accept your order.  Goods supplied are not for resale.

You can request to submit an order by using the online store at fandomcrossstitchery.com.  Please ensure that the email address you use is accurate and up to date.  Once payment is received in full, a binding agreement will exist between you and us on these terms and conditions.

 

Once your order is placed, goods will be delivered to you in one of two ways:

  1. Digital files will be emailed to the email address you provide to us.  This will usually be done within 1 working day, although we reserve the right to take up to 5 working days if extenuating circumstances exist.  If you have purchased a digital item (listed on the online store as ‘pattern’ or ‘PDF’) no physical item will be shipped to you.

  2. Physical orders will be shipped to the shipping address you provide us during checkout.  This will usually be done within 1 working day, although we reserve the right to take up to 5 working days

 

We may not accept your order if:

  • There is a problem with your payment or order.

  • We find a product or pricing error.

  • You do not accept these terms and conditions.

 

If we do not accept your order, you will be notified via an email to the email address you supplied to us when placing your order, and refunded if applicable.

 

All products are subject to availability.  We cannot guarantee the availability of advertised products but will endeavour to ensure the accuracy of the content of our site.  We reserve the right to change or withdraw products without notice if we deem it necessary.

Whilst we take great care to ensure the accuracy of our product descriptions, there may be a difference between the actual product and photographs of it on our website.  The way in which colours are represented will depend on your computer settings.  All measurements are approximate.

 

2. PAYMENT

Payments are accepted and processed through Wix.com, using a secure third party payment service provider.  Whilst we make every reasonable effort to ensure payments are conducted in a secure environment, we cannot accept responsibility for the operation of the payment provider and will not be held liable for any loss you may suffer, if a third party obtains unauthorised access to any information provided via said payment provider. Please see Wix’s terms and conditions for further information.

 

We do not accept part-payments or payment plans; the invoice is to be paid in full.

 

3. PRICES

The prices displayed on our website are subject to change without notice.  The price of your product is applicable at the time of purchase.  Prices are not subject to VAT and do not include delivery; delivery charges are explained below.

 

We will not honour a price that is incorrect, even if we have, in error, confirmed your order at this incorrect price.  If we have erroneously confirmed your order at an incorrect price, we will contact you and refund / invoice you the difference.  If you do not wish to proceed at the correct price, you will be issued a full refund (excluding digital orders).

 

4. DELIVERY

Physical orders: Delivery charge is not included in the price of the product and will be clearly detailed in your invoice.  It will be charged at cost; we do not make a profit from our postage and packaging charges.  All deliveries will be sent via Royal Mail, details of current delivery charges can be found on Royal Mail’s website. Delivery dates and estimates cannot be guaranteed.  

 

UK orders over a value of £20 will be sent via Royal Mail Signed For, and orders over £50 will be send Royal Mail Special Delivery.  All international orders (i.e. destinations outside of the UK) will be sent via Royal Mail International Tracked & Signed where this service is offered.  Proof of postage is obtained for every order dispatched.

 

If you are not at home or otherwise unable to sign for the parcel, a card will be left by the delivery driver with details on how to retrieve your order.  More information can be found on the courier's website.  You will be responsible for the products as soon as they are signed for.  We will not be held responsible for any failure on the part of the courier to deliver your order.

 

Digital Orders: digital files are sent via email. No physical product will be shipped to you.  Please ensure the email address you provide during checkout is accurate as mistakes cannot be rectified once the order email has been sent.

 

5. CANCELLATIONS & RETURNS

We reserve the right to cancel any order for any reason, and will notify you via email.  Possible reasons include, but are not limited to the following:

  • Potentially fraudulent order.  If we believe the order to be from a fraudulent source, or are otherwise in doubt as to the validity of the order, then we may cancel an order without notice.

  • Incorrect pricing.  For more details on this please see point 3: ‘Prices’ above.

  • Illness.  In the highly unlikely event that illness on our part prevents shipment of your order to such an extent that it cannot be completed within a satisfactory amount of time, we will contact you to arrange cancellation of your order and a full refund will be issued.

 

If we cancel an order after payment has been made, a full refund will be processed.

Your right to cancel:

You are free to cancel your order at any stage before shipping (excludes digital items).  Cancellations will only be accepted in writing or via email. You can contact us via email at fandomcrossstitchery@mail.com 


If you wish to return your order, please contact us via email for authorisation prior returning it.  

Under the UK Distance Selling Regulations and Sale of Goods Act, you have the right to cancel & return your order within 14 calendar days of receipt (‘receipt’ being defined as the date the order was signed for with the courier service).  You do not need to give a reason for cancelling. 

 

You are responsible for the costs of returning the goods to us, and you must return any packaging and instruction booklets along with the order.  You have a statutory duty to take reasonable care of the goods while in your possession. You must take reasonable care to ensure that we receive the goods and that the goods are not damaged in transit.  If you do not exercise reasonable care, and the goods are damaged, we may claim against you for breach of this statutory duty.  

 

We will process your refund within 14 days.

 

If you reside within the EU, as per the Consumer Rights Directive, you have are entitled to the Right to Withdrawal (also known as a "Cooling-Off Period" or "Cancellation Period").  This means you can change your mind, for any reason, within 14 calendar days of receipt of your order, ('receipt’ being defined as the date the order was signed for with the courier service).  

 

You must contact us within 14 days, and we will instruct you on how to return your product.  You are responsible for the costs of return shipping.  You also have the right to use the EU's Online Dispute Resolution platform ec.europa.eu/consumers/odr, although we would urge you to contact us before resorting to this.

 

Faulty Orders:

If you believe your order to be faulty, you must contact us within 14 calendar days of receipt ('receipt’ being defined as the date the order was signed for with the courier service), providing a description and photographs of the fault. If the product is deemed by us to be faulty, or your rejection of faulty goods is deemed by us to be valid, we will contact you to determine whether a repair, replacement, or full or partial refund is preferable; supply you with a return address and cover shipping costs.

Exemptions:

  • We will only accept returns of bespoke/made-to-order products if they are deemed, by us, to be faulty.

  • The above rights do not apply to digital goods (listed on the online store as ‘pattern’ or ‘PDF’).  We cannot accept cancellations or returns on any digital orders, including bespoke/made-to-order items.

  • If you do not contact us within 14 calendar days of receipt, we are under no obligation to accept return of goods for any reason.

6. WARRANTY

We offer no warranty for our goods but we take every reasonable precaution to ensure that they are durable and of high quality.

 

It is our responsibility under the Sale of Goods Act 1979 to ensure that our products conform to contract, are of a satisfactory quality and are fit for purpose.  This means we must ensure that all product descriptions are accurate; that the products are safe, free from defects and function properly; and that the products are capable of doing what they were designed for (i.e. providing a kit for an adult to create a craft project using cross stitch techniques).  We make every effort to ensure that our descriptions are up to date and accurate.  We use high quality materials to ensure the quality and safety of each product, and our design process ensures the instructions fulfil their purpose of offering an understandable way of creating a finished product that resembles the pattern provided.

 

7. INTELLECTUAL PROPERTY

We reserve the intellectual property rights to the design of our patterns. The customer can claim no intellectual property rights over finished works created from our patterns.

 

8. DATA & PERSONAL DETAILS

When you post any material to our website or social media pages, you grant us non-exclusive, worldwide, perpetual, royalty-free licence under your copyright and other intellectual property rights to use or display or distribute said material in any way without any duty to account to you.  We will normally contact your before using or displaying your material, but are under no obligation to do so.

 

To the extent that it is legally possible, we make no warranty that our website and services will meet your requirements; that your use of our website will be error-free; or that any errors or inaccuracies will be corrected.  We will not be held liable for any damage or loss incurred from your use of our website.

 

We take every reasonable precaution to protect any personal data you share with us. For full details of how we use and store your data, please see our Privacy Policy.

 

We retain the right to delete any material transmitted to us by you and will not be held liable for deleting or failing to store any such material.

9. EXTERNAL LINKS

We may provide links to other websites or resources.  We do not endorse the contents of these websites and will not be held responsible for their content or their privacy policy.  If you visit third party links you do so at your own risk and we cannot be held liable for any damage or loss incurred from your use of external websites.

11. LIABILITY

We accept no responsibility for, nor will we be held liable for any damage, injury or loss sustained through improper use of our products.  It is your responsibility to check the products for faults before use.   It is your responsibility to read all instructions and safety warnings prior to use.  Instructions and warnings are available on the website and enclosed in hard copy with your order; safety warnings are listed again below under point

 

12: SAFETY 

You must ensure you have read and fully understood these instructions before using your kit or needleminder.  If you are in any doubt about safe operation, you must contact us for clarification before attempting to use the product.  Failure to adhere properly to the instructions and warnings may result in injury.

12. FORCE MAJEURE 

In these terms and conditions, a ‘Force Majeure Event’ means any act of God including (but not limited to) any fire, flood, earthquake, windstorm or other natural disaster; act of any sovereign or government including (but not limited to) any war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, act of terrorism, military or usurped power or confiscation, nationalization, requisition, destruction or damage to property by or under the order of any government or public or local authority or imposition of any government sanction, embargo or similar action; law, judgement, order, decree, blockade, labour dispute including (but not limited to) any strike, lockout or boycott; interruption or failure of utility service including (but not limited to) electric power, gas, water or telephone service; failure of any transportation or any personnel equipment or machinery, the shortage of any product(s) or material(s) required by the us for completion of the relevant order/contract and/or (without prejudice to the generality of the foregoing) any other event or circumstance that is beyond the reasonable control of the party in question.

 

Neither we nor you will be liable to the other for any delay in performing, or for any failure to perform, any of its obligations under these terms and conditions that is caused by any Force Majeure Event.  The party claiming that the Force Majeure Event has affected the performance of its obligations will promptly notify the other party in writing of the reasons for the delay or stoppage (and the likely duration thereof) and will take all reasonable steps to overcome the delay or stoppage, to bring the Force Majeure Event to a close or otherwise to find a solution by which the relevant order/contract may be performed despite the Force Majeure Event affecting the party in question.


If the party affected by the Force Majeure Event has complied with the above provisions of this paragraph, the performance of its obligations under these terms and conditions will be suspended for the period that the Force Majeure Event continues, and such party will have an extension of time for performance which is reasonable in all the circumstances.  As regards any such delay or stoppage any costs arising from the delay or stoppage will be borne by the party incurring those costs, and either party may, if the delay or stoppage continues for more than thirty continuous days, terminate the relevant order with immediate effect, on giving written notice via email to the other party and, in any such case, neither we nor you will be liable to the other for (or in connection with) any such termination.

13. GENERAL

This copyright disclaimer ("Disclaimer") outlines the terms and conditions governing the use of digital cross-stitch patterns ("Patterns"/”Digital Patterns”) provided by Fandom Cross Stitchery ("we”/”us”/”our"). By purchasing and downloading any Patterns, you agree to adhere to the following terms:

 

1. USAGE RIGHTS:

a. You are granted a non-exclusive, non-transferable license to use the Pattern to create an unlimited number of cross-stitch pieces for personal or commercial purposes.

2. CREDIT REQUIREMENT:

a. If you choose to sell cross-stitch pieces created using this Pattern, you must provide proper credit to Fandom Cross Stitchery as the original designer. Credit should prominently feature our business name and, where applicable, a link to our website or online store.

3. RESTRICTIONS:

a. You are expressly prohibited from selling, distributing, sharing, or transferring the Digital Patterns to any other individual or entity.

b. You may not reproduce or replicate the Digital Patterns for resale, distribution, or any other purpose.

c. You may not modify the Patterns (digital or printed) and sell them as your own creations.

d. You may not create any other products (e.g. cross-stitch kits, stickers) for sale or distribution that are based on our Patterns

4. PRINTING:

a. You are permitted to print the Patterns for your personal use to facilitate cross-stitching projects. This includes printing for reference during the creation of cross-stitch pieces.

b. You may not print and distribute or sell the Patterns in physical or digital form to others. The printed Patterns are for your personal use only and should not be shared, sold, or otherwise distributed.

5. COPYRIGHT OWNERSHIP:

a. The copyright and all intellectual property rights for these Digital Patterns remain the exclusive property of Fandom Cross Stitchery. Your purchase of the Patterns grants you a limited license, but it does not transfer any ownership rights.

6. DISCLAIMER OF WARRANTY

a. Fandom Cross Stitchery provides the Patterns "as is" without any warranties, express or implied, regarding their accuracy, completeness, or fitness for a particular purpose

7. CORRECTION OF INACCURACIES

a. Fandom Cross Stitchery is committed to providing accurate Patterns. If you discover any inaccuracies or errors in the Patterns, please feel free to contact us. We will make reasonable efforts to correct any identified inaccuracies promptly.

PRIVACY POLICY

1. WHAT DATA WE COLLECT

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.

 

To fulfil your order, you must provide us with certain information (which you authorised Wix to provide to us), such as your name, email address, postal address, payment method, and the details of the product that you’re ordering.  You may also choose to provide us with additional personal information such as  comments, feedback, product reviews, recommendations, and personal profile, other personal information (such as for a custom order).

4. HOW YOUR DATA IS STORED

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We will never knowingly disclose your data to third party services and will never sell your data.

For the purposes of sales analysis, we do store some customer data outside of Etsy, in the form of an encrypted and password-protected file.  The computer on which it is stored is password-protected, and protected by antivirus software and regular security updates.

 

We have made every effort to abide by the UK GDPR.

5. DATA RETENTION 
We retain your personal information only for as long as necessary to provide you with our services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements. We generally keep your data for 5 years.

6. SHARING YOUR DATA
Information about our customers is important to our business. We share your personal information for very limited reasons and in limited circumstances, as follows:

  • Wix. We share information with Wixas necessary to provide you our services and comply with our obligations under Wix Policies and Terms of Use.

  • Service providers. We engage certain trusted third parties to perform functions and provide services to our shop, such as Royal Mail and other delivery companies. We will share your personal information with these third parties, but only to the extent necessary to perform these services.

  • Business transfers. If we sell or merge this business, we may disclose your information as part of that transaction, only to the extent permitted by law.

  • Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce our agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our customers, or others.

We will not share your information to any third party for marketing purposes.

 

Customers Outside the UK:
By providing your personal data to us, you expressly consent to the processing of your personal data by us or on our behalf. Of course, you still have the right to ask us not to process your data in certain ways, and if you do so, we will respect your wishes.


Sometimes we'll need to transfer your personal data between countries to enable us to supply the goods or services you’ve requested. In the ordinary course of business, we may transfer your personal data from your country of residence to us and to third parties located in the UK (e.g. Royal Mail).


By dealing with us, you are giving your consent to this overseas use, transfer and disclosure of your personal data outside your country of residence for our  ordinary business purposes. This may occur because our information technology storage facilities and servers are located outside your country of residence, and could include storage of your personal data on servers in the UK.
 

7. HOW WE MAY CONTACT YOU

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email.

 

If you have placed an order for one or more digital pattern files, we will use the email address you provided during checkout to send you those files.  You will also be sent automated emails from the Wix platform to update you on the status of your order.

 

8. COOKIES

 You have the option to disable non-essential cookies. 9. YOUR RIGHTS

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:

  •  Change, restrict, delete. You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where we are required to store data for legal reasons) er will generally delete your personal information upon request.

  •  Object. You can object to our processing of some of your information based on our legitimate interests. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

  • Complain. If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Safety Information

SAFETY INFORMATION

You are responsible for the safe and proper use of any products purchased from us.  We accept no responsibility for injury resulting from improper use of one or more of our products.  Relevant safety information is provided with all orders.

1. NEEDLEMINDERS:

  • Magnets are incredibly strong and can jump together from several inches apart.  Be careful not to place skin or body parts between magnets as they can pinch or become trapped.

  • Magnets are brittle. Do not allow magnets to slam together as they can chip, crack, or shatter. 

  • Keep away from children, not a toy.  Small parts can be swallowed.

  • Keep away from anyone with a pacemaker or a nickel allergy.

  • Keep away from electronics & magnetic media.

  • TO SEPARATE MAGNETS, SLIDE THEM APART.

 

2. CROSS STITCH KITS:

  • Not a toy; keep out of reach of children.

  • Intended for use by adults only.

  • Small parts; danger of swallowing.

  • Needles are sharp – do not place in mouth. Take care during use. Keep away from children.

  • Thread is a strangulation risk.  Keep away from children.

GIFT CARD T&Cs

  • Gift cards are available in digital form only.  They will be automatically emailed to the recipient you specify. No physical card is shipped.

  • Cards expire 5 years from date of purchase.

  • Gift cards are non-refundable, nor can they be exchange for currency of any denomination.

  • If the order you place is of a higher value than that of the card, you must pay for the remaining cost using one of our regular payment methods.

  • If the order value is of a lower value than that of the card, the unspent amount will remain on the card and can be spent at any time before the expiry date.  No change is given.
